Today, December 19, the 535 electors of the Electoral College will officially cast their votes for President of the United States. Never in U.S. history has the Electoral College failed to confirm the presidential votes of their respective states. To do so would amount to a constitutional crisis of epic proportions. I dare say, if such an event were to happen today, the American people would rise up in anger and defiance not seen since our War for Independence. Like few in modern memory, this election proves the wisdom of our Founding Fathers to institute the Electoral College (EC). The whole ideal of the EC was to keep large metropolitan areas from being able to dictate the elections due to the sheer magnitude of their population centers. Without it, people who live outside America's major cities would be effectively without a voice and a vote in choosing their President. Think of it this way: without the EC, the cities of New York, Chicago, and Los Angeles (along with a few other major cities--all of which tend to be liberal by nature) would select our President in EVERY election. Rightly did Thomas Jefferson say that big cities were a "bane" of freedom. And so they are. And ONLY the EC prevents these gigantic metropolitan areas from running roughshod over the rest of the country. THANK GOD FOR THE ELECTORAL COLLEGE! And lest some people don't know me well, I would defend (and have defended) the EC even when a liberal Democrat won the electoral vote. It's amazing how Clinton's supporters (including George Soros) would be willing to overthrow our very form of government--by hook or by crook--to put her in the White House. And, yes, many Republicans are just as bad. But the truth is we can thank our Founding Fathers for the EC, because it has preserved our form of government for these 200+ years. Despite intimidation--and even death threats--from the radical left, I look for our states' electors to be faithful to their oaths, to the people of their states, and to our Constitution and confirm Donald Trump as the 45th President of the United States today.

Overall, it was a successful election for OCPAC. Eighty-one percent of candidates endorsed by OCPAC won election. In the state Senate, all three of our endorsed candidates won. In addition, we picked another four candidates, all of whom won. In the state House of Representatives, nine out of twelve OCPAC endorsed candidates were victorious, and eighteen out of twenty-six of our picks won. What impact did Libertarians have on these contests? OCPAC-endorsed candidate Molly McKay came up short against a Demonrat by 623 votes, while the Libertarian took a total of 941 votes. In this race it is safe to say that one liberty-loving candidate prevented another liberty-loving candidate from winning. Therefore, a collectivist and crony capitalist Demonrat took the seat. This dynamic explains why we encourage Libertarians to work within the Republican Party so that their ideas can influence our majority party to be more serious about personal liberty and free markets. The split vote in this race was a net negative for liberty. Similarly, in another three-way race, the Libertarian candidate took 981 votes, which caused Republican Bruce Lee Smith to come in second by 431 votes. In this case the Libertarian did liberty a favor by preventing a RINO from being elected. With a strong majority of Republicans in the House, liberty is better served by throwing a few seats to Demonrats, rather than continuing the corruption of the Republican caucus. The split vote in this race was a net gain for liberty. In both of these cases, we see a strong argument for a playoff when no candidate obtains more than fifty percent of the votes. In summary, OCPAC candidates did well. The people voted for liberty, free markets, and smaller government. Now, will these elected officials follow through on setting us free? Legislators who understand the principles of liberty will still be a minority within the majority party. They will need encouragement, fortitude, and practical support from us. Why did SQ 790, repealing the Blaine Amendment, fail? Some would have us believe the reason is because Christians were afraid of a satanic monument on the capitol grounds. This explanation falls short of a full understanding of the problems. It only describes one small symptom of a much deeper sickness in the soul of our society. The first problem that SQ 790 could not overcome was a fundamental misunderstanding of the nature of our republic. Everyone, Christians included, has been taught in our government schools that we have a "separation of church and state," an un-crossable divide between God and government. The vast majority of our population believes that we should erect and aggressively defend an impenetrable wall between God and government so that the two shall never touch. Government must not interfere in the internal workings of religious institutions, but more importantly, God and his followers must never influence or affect the policies of our civil institutions. This was never the intent of our founders, and certainly God cannot expect us to be salt and light without engaging the culture. The design of our founders and the natural law rights of man demand a different understanding of the separation of church and state. The wall was originally designed to be a prison wall around the state to keep it from dictating, controlling, or enslaving people of faith. It was to be a one-way hedge of protection. It was never intended to keep God or his followers from influencing public policy or serving civil society, from living and working behind the iron curtain of the state. With God absent from the state, evil will fill the vacuum. I predict we will now see progressive groups go to work in the courts, using the Blaine Amendment to strike down services provided by people of faith and to discriminate against faith-based organizations. The second problem goes to the soul of society. We value liberty and freedom of choice; we do not want know-it-all, government busybodies butting into our lives and telling us what to do. This in itself is a worthy quality and one which leads us to reject authoritarian forms of government. The love of liberty and rejection of authority grows the Republican and Libertarian parties, and during this election, it manifested itself in the rejection of the Clinton's criminal empire and the rejection of Boren's new statewide tax (another huge victory!). We are in a time when more and more people are rejecting authority. For the most part, this is a good thing, since most authority structures are illegitimate means of controlling the masses. However, what we saw in the defeat of SQ 790 was the total rejection of all authority, including the ultimate true authority of God. Collectively, we have gone too far. We rejected Hillary, and we rejected crony capitalism, but we got carried away and rejected God, too. People want to be free to fornicate, murder their babies, and steal from each other to fund pet projects. Therefore, they would rather not be reminded by the Ten Commandments that those things are wrong. No one, not even God, should tell them what to do. This is the deeper, subconscious, reason SQ 790 was rejected: Our culture wants God out of government so people can be free to sin. SQ 777, the right to harm, was defeated. People are fierce defenders of their liberties when the attack is obvious and easy to explain. OCPAC cannot take all the credit for the defeat of SQ 777, but we were part of the team that highlighted the attack on our property rights. Our video on SQ 777 had over 33,000 views by election time, and we hit the airwaves with Pat Campbell during the morning drive-time on three different days. People eventually got the message that we should not rewrite our Bill of Rights to read like SQ 777: · Congress shall make no law prohibiting the exercise of religion, without a compelling state interest. · Congress shall make no law abridging the freedom of speech, without a compelling state interest. · The right of the people to keep and bear arms shall not be infringed, without a compelling state interest. · The right of the people to be secure in their persons and property shall not be violated, without a compelling state interest. · No person shall be deprived of life, liberty, or property, without a compelling state interest. Judging Justices. OCPAC waged a short campaign against two sitting Oklahoma Supreme Court justices. During the month leading up to the election, our members visited most major towns in the state to get the word out that these justices have blood on their hands. Were we successful? While the justices were not unseated, our efforts had a huge impact, sending a loud message to the courts and to the Legislature. During the presidential election of 2012, judges and justices across the board in Oklahoma received an average of 33.5%!N(MISSING)O votes. This year, judges and justices received an average of 39.5%!N(MISSING)O votes, a swing of six whole percentage points. In the case of Justice Combs, who was targeted by OCPAC, his NO votes increased 7.68 percentage points! Had this been an off-year election, with lower turnout, where informed, grassroots activists make up a higher percentage of voters, Combs very well could have been defeated. This tremendous impact should embolden the Legislature to give us judicial reform. We need better accountability for our highest court, the kind that competitive elections would bring. Given the impact that OCPAC had on the vote, imagine what a candidate for justice of the Oklahoma Supreme Court could do with financial support and an extended campaign to unseat a bad justice like Combs

Our fellow small Farmers and Ranchers won by almost 21%!!(MISSING) We must be vigilant this next legislative session and stay on top of our weak-kneed legislators in order to prevent more detrime

He made the comment that SQ777 will "grant rights to farmers that will rival that of the 1st and 2nd amendments". MAJOR problem with that statement is government cannot grant rights. The government has authority to ONLY secure your rights for your free use not create and grant them. If they are ONLY to secure them for your free use then the words "without compelling stat interest" would not be found in the measure. SQ777 is not as straight forward as they say. Bottom line is farmers ALREADY HAVE THE GOD GIVEN RIGHT TO FARM. The government is currently infringing upon that right. SQ777 solidifies (or lays false claim) that the state can infringe on those rights if there is a "compelling state interest." At best SQ777 is a noble attempt gone horribly wrong and at worst a devious attempt for the state to secure YOUR rights with new state constitutional provisions so the state can dictate to us how and when they are to be used.

Mark Yates, who is one of the original proponents of 777, told me that the use of the language " without a compelling state interest" places any legislation under higher scrutiny, that the courts will be able to strike down any legislation that does meet the compelling state interest test. When you look at the language in 777 and compare it to the language found in the second amendment of the US Constitution, this argument of the compelling state interest setting a "higher" level of scrutiny just doesn't fly. The language in the second amendment states "the right of the people to keep and bear arms SHALL NOT be infringed". The phrase "shall not' is an emphatic denial or refusal of the verb "be infringed". The test of high scrutiny gets no higher than that. The other argument is that the phrase compelling state interest doesn't qualify the ability of the legislature to act. Here is the language right of the ballot description of the question: no law can interfere with these rights, unless the law is justified by a compelling state interest—a clearly identified state interest of the highest order. Additionally, the law must be necessary to serve that compelling state interest. The Oklahoma State Attorney just said in it's explanation that your right could be interfered with, and told you just how it would happen, by justification of the compelling state interest, and yet supporters of 777 say it can't happen. Let that sink in a minute. So the whole debate is 777 won't qualify your rights, even though we know that the same concept of compelling state interest set out in 777 has already been proven to do that by the US Supreme Court, and the same is acknowledged by the Oklahoma Attorney General in it's ballot description of 777's intent. Tell me how that is rational because I can't see it.

Last week's analysis of State Question 777, the proposed "Right to Farm" amendment to the state constitution, elicited a lot of feedback. Almost everyone agreed with our concerns. Particularly, two conservative attorneys whom we trust agreed that SQ 777 was dangerous. However, one conservative attorney who is also a legislator disagreed and voiced his support for SQ 777. His argument deserves thoughtful consideration, but before we do that, let us review the basics. First, the right to farm is already the status quo by natural law. The purpose of the state is to protect property rights, not violate them. By default, you are free to farm any way that does not harm your neighbor or his property. If your farming methods do harm your neighbor, then the state has a duty to pass laws which codify the penalty for your unjust actions. If, however, the state codifies regulations which penalize you or harm your farm when you have caused no harm, then the state is violating your natural rights. These types of regulations must be fought and overturned. Similarly, you have a natural right to free speech and practice of religion. No law needs to be enacted to give you those rights. By default, you may speak and preach any way that does not harm your neighbor or his property. This is why many anti-federalist Founders argued against the passage of a Bill of Rights. By default, Congress already had no authority to legislate against unalienable rights from God. Nevertheless, look what happened. No sooner had the states amended the U.S. Constitution to explicitly state "Congress shall make no law," than Congress began making laws to regulate free speech. The same thing can be expected to happen to our property rights. As soon as we say "The Legislature shall pass no law," our Legislature will begin testing the limits of the limit. Even if SQ 777 were a straightforward prohibition, like the Amendments in the Bill of Rights, we would be concerned, but SQ 777 is not a straightforward prohibition—it is political double speak, and double speak as been elevated to an art form in our day. Let us explain. In mathematics we know that multiplying two negatives produces a positive. This is an undisputable fact. Did you know that grammar works the same way? Perhaps you have heard of the "double negative?" In grammar, as in mathematics, two negatives make a positive. Politicians like double negatives because they can fool an audience into believing they are hearing about prohibitions. We want to prohibit the state from trampling our rights, so when we hear the negatives in SQ 777, we tend to think it is a prohibition of state power, but we should not be fooled by the political double negative. Two negatives make a positive. Let us make this eminently clear. SQ 777 has a lot of highfalutin language and window dressing phrases which make it sound historic and wonderful, but here is the heart of the measure stripped down to its effective sentence: "The Legislature shall pass no law which abridges the right [to farm] without a compelling state interest." This is a double negative (no and without). Let us remove the two negatives so that you can read the measure as a positive: The Legislature shall pass law which abridges the right [to farm] with a compelling state interest. Are you scared yet? We are. Now, our good attorney friend in the Legislature says not to worry; we have added a new speed bump for the Legislature with the "compelling state interest." He explains that legislators currently have the ability to pass farming regulations based on nothing more than their fancy, justified by nothing more than their own reason. He argues that a requirement to meet a "compelling state interest" will put an additional check on the Legislature and make it harder for them to interfere with farming. Sounds sound. But wait. Here is problem number one. Who is going to decide what constitutes a "compelling state interest?" The answer is the courts. We have added a speed bump, but it is on a road over in a different branch of state government. That branch of government is notoriously liberal. What happens when the Oklahoma Supreme Court interprets "compelling state interest" in a progressive way that allows the Legislature to pass all kinds of onerous regulations? By amending the state constitution and allowing the court to define the terms, we are now stuck with a high level of codified tyranny that is hard to correct. It is not easy to amend a state constitution. Problem number two is related to problem number one. Remember, SQ 777 also says that any regulations existing prior to 2015 shall not be affected by the amendment. This provision could be interpreted by the Oklahoma Supreme Court to mean that existing regulations are constitutionally protected. In this case we will have lost our ability to remove unjust laws enacted before 2015. This brings us to problem number three: accountability. If the Legislature violates our property rights through law, we can unseat the responsible parties and change the law. However, when judges violate our rights, they never get unseated. Without competitive elections in the judiciary, the people have little to no oversight. We will be stuck with their secular humanist interpretations for generations since the Legislature, the Governor, and the people have been conditioned to bow down in worship to judges. Any so-called speedbump in the judiciary might become a high-speed autobahn to tyranny. In conclusion, will SQ 777 defend us against future unjust laws of the Legislature? Because it is a double negative, the answer is no; it will not protect us. Furthermore, it may strengthen the position of existing unjust laws by adding a kind of affirmation in the state constitution. Finally, by shifting responsibility from the Legislature to the judiciary, we remove accountability. Our best defense against an unjust Legislature is the ability to unseat legislators and change the law. If we were to amend our state constitution as SQ 777 proposes, it would allow the judiciary to ensconce the mechanism for systematic tyranny over farmers. Thus, even after careful consideration of the arguments in favor of State Question 777, it still looks more like a "Right to Harm." Vote NO.

You were not born with a Social Security number tattooed on your left foot. You did not exit the birth canal with a Federal Tax ID barcode on your right foot. The state may act like it owns you, but you were born free. As owner of your body, you have the unalienable right to work, to create goods, and to hire yourself out as labor. If you want to dig a ditch for someone, go right ahead. Work. Provide for yourself and make a living. The state, on the other hand, has a different view of things. Too many of our legislators view people as natural resources, property of the state to be directed and controlled by the state. They believe you may not dig a ditch for anyone without permission. You must be authorized to perform that work by obtaining a state license. Many collectivist states issue "work permits," which more aptly describes what a license really is: permission to work. Year after year the Legislature adds new licensing requirements. This year they decided that massage therapists must be licensed. This will be a tremendous burden to thousands of professionals across the state. Many who practice massage only part time for extra income will have to give it up altogether or practice illegally. On the other hand, when wives complain of tight shoulders and tired feet, husbands can now get out of massage duty with the simple retort, "I'm not licensed!" The most ridiculous example of state licensing to date was the one used on this year's Conservative Index. We thought it must surely have been a joke, but it was not. The legislature passed a measure requiring a license for music therapists! God forbid anyone sooth our anxiety about our liberal Legislature by playing music. It might be illegal. The Music Therapy Practice Act, by Rep. Lee Denney (R-Cushing) and Sen. Stephanie Bice (R-OKC), passed the House 54-42, passed the Senate 38-7, and was signed into law by Gov. Fallin. A vote against the bill demonstrates conservative principle and policy.

Part two of our series looking at Conservative Index issues will examine the policy of our legislators regarding debt. If you had lost your job and were going broke, you would not choose that time to borrow $125,000 to remodel your home. Furthermore, you certainly would not borrow that sum without consulting your spouse who has a shared interest in the home. Likewise, when the state is losing jobs and running a budget deficit, that is not the time to borrow $125,000,000 to renovate the Capitol. Renovation can wait until better economic times. Yet that is what the Legislature did by passing House Bill 3168, which was authored by Speaker of the House Jeff Hickman and Senate President Pro Tem Brian Bingman. Furthermore, as irresponsible as it was to borrow the money, the Legislature did it without consulting the people to whom the Capitol building—and now the debt—belongs. Both of these actions are the antithesis of conservative, and they even violate the specific direction of the Oklahoma Constitution which requires the budget be balanced and any bonded indebtedness be approved by a vote of the people at a general election. This vote was therefore, unwise, immoral, and unlawful. Note that this bill was sponsored by House and Senate leadership. We want future leadership to understand that using strong-arm tactics to move such egregious bills through the Legislature is unacceptable. We have high hopes that such measures will not be sponsored under the leadership of Speaker-designate Charles McCall (R-Atoka). Although Rep. McCall walked three important votes this year and voted for the Capitol bonds, he does have conservative instincts, having scored 90%!i(MISSING)n 2015. With a lifetime average of 74%!,(MISSING) he has the potential to become one of our more conservative Speakers. Only time will tell. The additional bond funding was approved by the House 51-43 and by the Senate 30-16. Gov. Fallin signed it into law on June 6. A vote against the bill demonstrates conservative principle and policy.

So Governor Fallin (Bloody Mary) vetoed legislation today which would have made it a felony for a doctor to murder an unborn baby, vetoed a bill which would have allowed property owners day or night to kill feral hogs and vetoed a gun rights bill. Bloody Mary values the lives of wild pigs over innocent unborn children. If Oklahoma is the Reddest state in the nation, it's not because of a Republican Super Majority it's due to the blood of innocent unborn children!

HJR1009 In Trouble! The Republicans are at it again. HJR1009 - OK2A's proposed amendment to the Oklahoma Constitution that would strengthen the right to keep and bear arms in Oklahoma - is in serious trouble. Some of the House Republicans have drank David Boren's Cool-Aid. We know two Republican Representatives have said not just no, but no way to signing HJR1009 out of conference. We will include their names and contact information below. As the day progresses, we will add names as needed. But, first, some points for you to use as you make calls and send emails: 1. The Thunder will NOT leave OKC because of HJR1009. If that was truly inevitable, explain why the Pelicans (NBA) are still in New Orleans 4 years after Louisiana added the same language to their state constitution? 2. It will not change the fact that events at public venues will be controlled by whomever is organizing the event. When leasing a facility, the entity leasing has legal control and can set a no-gun policy. That will not change. 3. David Boren, who opposes this amendment, is a member of the Board of Advisors for Everytown for Gun Safety - Michael Bloomberg's anti-gun organization. David Boren doesn't seem to care if Oklahomans know he has thrown in with Bloomberg, but do Reps. Watson and Wright want everyone to know they are siding with Bloomberg while he stands against gun rights in Oklahoma? We appreciate Representatives Tommy Hardin and Jason Nelson for agreeing to support HJR1009 by signing. However, we need you to call Representative Weldon Watson and Representative Harold Wright and ask them why they have decided to stand with Bloomberg and against the right of Oklahomans to keep and bear arms. Urge them to change their minds and sign HJR1009 out of conference. Remember, be polite but be firm.
